15-year-old boy appears in court for defiling and infecting six-year-old girl with HIV

What happens in a situation where a child contaminates another child? Not only that, but the 15-year-old also infects the younger one with HIV.

This is an active case that an Eldoret magistrate had to deal with this week.

The 15-year-old boy at the center of the case pleaded guilty before an Eldoret court in the case in which he is accused of defiling and infecting a six-year-old girl with HIV.

Due to the nature of the case and the subjects involved, the statement was taken behind closed doors. The defendant, an eighth grader, was said to have been born with the virus.

The minor was charged with defiling another minor in contravention of Sections 8(1) and 8(2) of the Sexual Offenses Act 2006.

The charge sheet states that on various dates between January and April of this year he defiled the girl. He was also charged with deliberate transmission of HIV contrary to section 26 of the Sexual Offenses Act 2006.

The accused, represented by lawyer Oscar Oduor, denied the allegation before Eldoret Chief Magistrate Dennis Mikoyani.

Advocate Oduor pleaded with the court to release the accused on lenient bail conditions, keeping in mind that he too was a child in need of care and protection.

“In examining the case before us, the court will appreciate that both the accused and the victim are children in need of care and protection. I kindly request this court to release the accused on lenient bail conditions,” Oduor told the court.

Following the defense application, the court released him on bail of Sh50,000 and a similar surety.

The matter will be mentioned on May 13 for further instructions on how to conduct the pre-trial phase.

Two weeks ago, another 14-year-old boy was accused of defiling a nine-year-old boy. The matter will be mentioned on Friday, May 3.

According to the police, the accused is being actively investigated for similar cases in which he allegedly defiled seven other minors.

Investigators say the teen has a history of defiling five girls and three boys.

He has become a frequent guest at the police station as a suspect in sexual crimes. He is accused of desecrating eight minors in his neighborhood, and seven of the cases are still under investigation. He has already been accused of sodomizing a colleague.

The eighth-grader was charged Monday with defiling a nine-year-old boy after he secured a pro bono attorney to represent him. The charge sheet alleged that the boy defiled a nine-year-old boy in contravention of section 8 of the Sexual Offenses Act 2006 in March.

Due to his age, the court was extremely lenient on him by allowing his mother to pay Sh8,000 as cash bail to secure his release pending hearing and determination of the case.

The boy had previously been arraigned in court to face charges of sexual offences, but due to his age and the nature of the offence, Eldoret Chief Resident Magistrate Kyne Odhiambo ordered that the boy be assisted in securing a pro bono lawyer.

Police suspect he began engaging in sexual activity at the age of 10. Among the victims are her playmates, children between five and nine years old.

“On a few occasions we have had to warn him and release him because of his age,” an investigator said during an application to the Eldoret court to detain the suspect pending investigations in one of the cases.

The investigating officer, who spoke off the record before an Eldoret magistrate, regretted that efforts to help the boy reform and prevent his appearance in court had been futile.

“We did not want to take the matter to court considering that the minor is a child who needs care and protection, but due to his inappropriate behavior we have been forced to seek legal intervention in the matter,” the officer said under condition. of anonymity.
